The accused withdrew his objection to a decree of accusation. The Pretura Penale therefore struck the case from the docket under Art. 210 cpv. 3 CPP and declared the decree of accusation enforceable. The court ordered that no court fees or judicial costs be levied.
Art. 210 cpv. 3 CPP; withdrawal of objection to a decree of accusation: if the accused withdraws the objection, the objection proceedings are terminated, the case is struck from the docket, and the decree of accusation becomes enforceable. In the absence of a contrary order, no costs are levied where the court so decides in the dispositive part.

Richiamata l'opposizione 8 novembre 2004 di
ACCU 1
interposta al decreto d’accusa n. di data 26 ottobre 2004 del AINQ 1 ;
considerato che con suo scritto 01/03 dicembre 2004, l’accusato ha dichiarato di ritirare la suddetta opposizione;
richiamato l’art. 210 cpv. 3 CPP;
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
§ L'incarto è ritornato al AINQ 1 per quanto di sua competenza.
Non si prelevano né tasse né spese di giustizia.
