The President of the Pretura penale noted the withdrawal of the objection against a criminal penalty order and, relying on Arts. 210 and 211 CPP, struck the matter from the docket. As a consequence, the penalty order became enforceable. The court also ordered that no court fees or costs be collected.
Arts. 210 and 211 CPP; withdrawal of an objection against a criminal decree d’accusa: where the objection is withdrawn before adjudication, the objection proceedings are terminated and the decree d’accusa becomes enforceable. In such a case, the court may order that no fees or costs be charged (consid. 1-3).
