The accused withdrew his opposition to a decree d’accusa at the hearing before the Pretura penale of Ticino. The judge therefore struck the proceeding from the docket, declared the decree d’accusa enforceable, and ordered the file returned to the issuing authority for any further action. No court fees or costs were imposed.
Art. 210 CPP; withdrawal of an opposition during the hearing terminates the objection proceedings and causes the decree d’accusa to become enforceable. In such a situation, the court strikes the case from the docket and may order the file returned to the issuing authority for further action. If no contrary order is made, no court fees or costs are levied.

richiamata l'opposizione 12 luglio 2004 di
ACCU 1
interposta al decreto d’accusa n. DA 2180/2004 di data 30 giugno 2004 del AINQ 1
considerato che nel corso del dibattimento penale tenutosi in data 25 novembre 2004, l’accusato ha dichiarato di ritirare seduta stante la suddetta opposizione;
richiamato l’art. 210 CPP;
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
§ L'incarto è ritornato al AINQ 1 per quanto di sua competenza.
Non si prelevano né tasse né spese di giudizio.
