The president of the Pretura penale noted the withdrawal of the objection against a criminal penalty order. The objection proceedings were therefore struck from the roll and the penalty order was declared enforceable. No justice fee was levied, but the objector was ordered to pay CHF 30 in costs for the decision.
Art. 210-211 CPP; withdrawal of the objection to a decree d’accusa: once the objection is withdrawn, the objection proceedings are to be struck out and the decree d’accusa becomes enforceable. The court may allocate the costs of the withdrawal decision to the objecting party; a waiver of justice fee does not preclude charging specific decision costs (consid. implicit).
