The Pretura penale of Bellinzona, by single judge Damiano Stefani, dealt with an opposition to a decree of accusation. The opposing party withdrew the objection during the hearing. The court therefore struck the proceedings from the docket, rendered the decree of accusation enforceable, and ordered that no fee or costs be charged. The case was sent back to the public prosecutor Monica Casalinuovo for any further action within her competence.
Art. 210-211 CPP; withdrawal of the opposition to a decree of accusation during the hearing. Upon withdrawal of the objection, the court strikes the objection proceedings from the docket and the decree of accusation attains legal force; the objection proceeding is thereby terminated. The court may also decide not to levy fees or costs for the termination order.
