Whether the criminal proceedings should continue after withdrawal of the complaint
The proceedings were struck from the docket because the complainant withdrew the complaint.
Once the complaint was withdrawn, the basis for continuing the proceedings fell away; the court therefore removed the case from the roll under Art. 31 CPS.
Whether the scheduled criminal hearing should still take place
The already fixed hearing was cancelled.
Because the case was struck out, the hearing became unnecessary and had to be annulled.
