The accused had objected to a summary penalty order. Before the scheduled hearing, counsel withdrew all criminal complaints that had triggered the proceedings. The Pretura penale therefore struck the case from the docket, returned the file to the prosecutor, cancelled the hearing set for the next day, and ordered that no fees or costs be levied.
Art. 31 CPS; withdrawal of the criminal complaint or complaints removes the procedural basis for the prosecution and justifies striking the case from the docket. In such a situation the court may cancel a scheduled hearing and, absent another basis for cost shifting, refrain from charging judicial fees or costs (consid. implicit).

Whether the criminal proceedings should be struck from the docket after withdrawal of the complaints
The proceedings had to be struck off because all criminal complaints forming the basis of the case had been withdrawn.
Once the complaints were withdrawn, there was no basis to continue the case; the court therefore removed it from the list and returned the file to the prosecutor for any further action within its competence.
Whether the scheduled main hearing should proceed
The already scheduled trial hearing was cancelled.
Because the proceedings were struck off following withdrawal of the complaints, the hearing became unnecessary.
