The President of the Pretura penale in Bellinzona noted that the complainant withdrew the complaint during the hearing on the opposition to the criminal decree. Applying Art. 31 para. 1 CP, the court ordered the proceedings struck off the docket and decided that no fees or costs would be charged. The decision was issued by President Marco Kraushaar.
Art. 31 cpv. 1 CP; withdrawal of the complaint during the hearing extinguishes the basis for continuation of the prosecution. In such a case the criminal proceedings are to be struck off ex officio, and the court may order that no taxes or costs be levied (consid. implicit).
