The Pretura penale of Bellinzona took note of the accused’s withdrawal of the opposition filed against a decree of accusation. The court therefore struck the case from the docket, cancelled the already scheduled public hearing, and declared the decree of accusation enforceable. It also ordered the opponent to pay CHF 30 in justice fees and CHF 50 in costs.
Arts. 210-211 CPP; withdrawal of opposition to a decree of accusation: upon notice of withdrawal, the court strikes the opposition proceedings from the docket, the decree of accusation becomes enforceable, and the scheduled hearing falls away. The procedural costs of the decision may be charged to the withdrawing opponent.
