The President of the Pretura penale noted the withdrawal of the opposition to a decree of accusation filed by the accused. Relying on Arts. 210 and 211 CPP, the court struck the proceedings from the roll and declared the decree of accusation enforceable. No court fee was levied, but CHF 30 in costs of the decision were charged to the objecting party.

Art. 210-211 CPP; withdrawal of opposition against a decree of accusation: once the opposition is validly withdrawn, the criminal objection proceedings are discontinued and the decree of accusation becomes enforceable. The court merely takes note of the withdrawal and orders the case struck from the roll; it may allocate the procedural costs to the objecting party. No substantive review of the decree is carried out (consid. 1-2).
