After the accused had lodged an opposition to a penal order, the complainant declared on 29 April 2004 that the criminal complaint of 6 May 2003 was withdrawn. The Pretura penale therefore struck the case from the docket and ordered that no court fees or costs be taken. The decision was signed by Judge Claudio Rotanzi with Michele Maggi as secretary assessor.
Art. 31 CPS; withdrawal of the criminal complaint in private-complaint proceedings; once the injured party validly withdraws the complaint, the criminal proceedings lose their procedural basis and are struck off the docket. The court may accordingly terminate the case without entering into the merits; where so ordered, no court fees or justice costs are levied (consid. implicit).
