Resumo

The Ticino Criminal Court president noted the withdrawal of an objection against a criminal decree of accusation. On that basis, he struck the case from the docket and declared the decree enforceable. No justice fee was levied, but the opponent had to bear CHF 30 in decision-related costs. The order was issued by President Marco Kraushaar of the Pretura penale and addressed to the public prosecutor Antonio Perugini and the opponent's counsel.

Arts. 210–211 CPP; withdrawal of an objection to a decree of accusation: upon valid withdrawal, the objection proceedings are struck off and the decree of accusation becomes enforceable. The court may waive the justice fee while charging the procedural expenses of the decision to the objecting party (consid. implicit).
