The opponent withdrew the objection to a decree of accusation. The President of the Pretura penale therefore struck the proceeding from the docket and held that the decree became enforceable. No justice fee was levied, but the costs of the decision, amounting to CHF 30, were placed on the opponent. The file was returned to the public prosecutor for further action within her competence.
Arts. 210-211 CPP; withdrawal of objection against a decree of accusation: upon valid withdrawal, the objection proceedings are discontinued and the decree of accusation becomes enforceable. The court may strike the matter from the docket and allocate the procedural costs to the objecting party; no justice fee need be collected if so ordered by the court.
