Resumo

The accused filed an objection to a penalty decree. Before the Pretura penale ruled on the merits, the complainant withdrew the complaint. The single judge therefore struck the proceedings from the docket and returned the file to the public prosecutor. The court ordered the complainant to pay a justice fee of CHF 30 and costs of CHF 30.

Art. 31 CPS; withdrawal of the complaint: where the complainant withdraws the complaint before judgment, the criminal proceedings are to be discontinued/struck from the docket. Procedurally, the court may return the file to the prosecuting authority. Unless otherwise provided, the procedural costs may be charged to the complainant who withdrew the complaint.
