The President of the Pretura penale noted that the opponent had withdrawn the opposition to a penal decree by letter of 13 May 2003. The court therefore struck the matter from the docket, declared the penal decree enforceable, and returned the file to the substitute public prosecutor for further action within his competence. No justice fee was charged, but the opponent had to bear the costs of the decision, fixed at CHF 30.
Arts. 210-211 CPP; withdrawal of opposition to a penal decree: once the opposition is withdrawn, the court removes the case from the docket and the penal decree becomes enforceable ex lege. The withdrawal terminates the objection proceedings without a merits review; the file is returned to the public prosecutor for the steps still within his competence. Procedural costs may be charged to the objecting party notwithstanding waiver of a justice fee (consid. implicit).
