The President of the Pretura penale dealt with an objection against a decree of accusation. After the objector withdrew the opposition by letter dated 8 August 2003, the court struck the case from the docket and declared the decree of accusation enforceable. No court fee was charged, but the costs of the decision, amounting to CHF 30, were imposed on the objector. The file was returned to the Public Prosecutor for further action within his competence.
Arts. 210-211 CPP; withdrawal of opposition to a decree of accusation: once the opposition is withdrawn, the objection proceedings are terminated by striking the matter from the docket and the decree of accusation enters into force. Costs of the procedural order may be charged to the withdrawing objector; a court fee may be waived where appropriate.
