The accused objected to a decree of accusation, and the civil party also filed an objection. On 22 September 2004 both withdrew their objections. The President of the Pretura penale therefore struck the case from the docket, held that the decree of accusation became enforceable, cancelled the already scheduled public hearing, and returned the file for further handling by the prosecution. The judicial fee and costs of CHF 80 were charged to the objector.
Arts. 210–211 CPP; withdrawal of objections against a decree of accusation: when the objection is withdrawn, the criminal proceeding is struck off the docket and the decree of accusation becomes enforceable. Any hearing already fixed is cancelled; the file is returned to the prosecuting authority for the steps still falling within its competence. Court fees and expenses of the order are charged to the objector.

Richiamata l'opposizione 21 marzo 2003 di
ACCU 1 (difeso da: DI 1
interposta al decreto d’accusa n. DA 961/2003 di data 20 marzo 2003 del AINQ 1 in seguito AINQ 2
rilevato che il 4 aprile 2003 anche la parte civile ha interposto opposizione,
preso atto che in data 22 settembre 2004 sia la parte civile, sia l'accusato hanno ritirato le suddette opposizioni,
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 24 settembre 2004 alle ore 09.00 non avrà quindi luogo; l'incarto è ritornato al AINQ 2 per quanto di sua competenza.
La tassa di giustizia di fr. 50.-- e le spese di fr. 30.-- relative alla presente decisione sono a carico dell'opponente.
