The opponent withdrew his objection against a criminal decree of accusation. The President of the Pretura penale accordingly struck the case from the docket, declared the decree of accusation enforceable, and returned the file to the public prosecutor for further action within his competence. No justice fee was charged, but procedural costs of CHF 30 were imposed on the objector.
Arts. 210-211 CPP; withdrawal of objection in criminal decree-of-accusation proceedings; upon valid withdrawal, the objection proceedings are struck from the roll and the decree of accusation enters into force. The court may at the same time regulate costs, including waiving a justice fee while charging the procedural expenses to the withdrawing objector (consid. implicit).
