The defendant withdrew the opposition previously filed against a 2001 accusation decree. The single judge of the Pretura penale of Bellinzona therefore ordered the case struck from the roll, noted that the accusation decree became enforceable, cancelled the already scheduled public hearing of 3 March 2004, and sent the file back to the competent authority. No fees or costs were charged.
Arts. 210 and 211 CPP; withdrawal of opposition to an accusation decree: once the objection is validly withdrawn, the criminal court strikes the matter from the roll, the accusation decree becomes enforceable, and any scheduled main hearing falls away. Absent a specific order, no fees or costs are to be levied for the strike-out decision.

Il pubblico dibattimento, già fissato per il 3 marzo 2004 alle ore 09:00 non avrà quindi luogo; l'incarto è ritornato al _AINQ0 per quanto di sua competenza.
Non si prelevano né tasse né spese dell'attuale decisione.
