The Ticino Pretura penale dealt with an objection to a penal order that had been withdrawn by letter in early 2003. Applying Arts. 210 and 211 CPP, the single judge struck the proceedings from the docket and declared the penal order enforceable. No court fee was collected, but the costs of the decision, fixed at CHF 30, were charged to the objecting party. The file was returned to the public prosecutor for further handling within his competence.

Art. 210-211 CPP; withdrawal of opposition to a penal order and procedural consequences. Once the objection is withdrawn, the court must strike the proceedings from the docket and the penal order becomes enforceable; the criminal challenge is thereby extinguished without substantive review.
