The defendant withdrew his objection to a criminal accusation decree during the hearing before the Pretura penale in Bellinzona. Judge Marco Ambrosini therefore struck the proceedings from the docket, declared the accusation decree enforceable, and sent the file back to the public prosecutor for further action within his competence. No fees or costs were charged.
Arts. 210 and 211 CPP; withdrawal of an objection to an accusation decree during the hearing terminates the objection proceedings by removal from the docket and renders the decree enforceable. The court may simply take note of the withdrawal without examining the merits; in the absence of a continuing dispute, no costs are to be charged where the decision so provides.

Once the objection was withdrawn during the hearing, there was no longer any pending challenge to the accusation decree, so the court ordered the proceedings removed from the docket under Arts. 210 and 211 CPP.
