Resumo

The Ticino Pretura penale dealt with an objection against a summary penal order. After the opponent withdrew the objection, the judge struck the proceedings from the roll, declared the summary penal order enforceable, cancelled the already scheduled public hearing, and returned the file to the public prosecutor for matters within his competence. Court fees and costs totaling CHF 80 were charged to the opponent.

Art. 210–211 CPP; withdrawal of an opposition to a summary penal order: where the objection is withdrawn, the court strikes the proceedings from the roll, the penal order becomes enforceable, and no public hearing is held. The procedural costs are borne by the objecting party. The file is returned to the public prosecutor for any remaining matters within his competence.
