The defendant withdrew his objection to an accusation decree by letter of 11 April 2003. The Pretura penale therefore struck the case from the docket, declared the decree enforceable, and cancelled the public hearing that had been set for 9 May 2003. The court further ordered that no court fees or expenses be charged.
Art. 210-211 CPP; withdrawal of objection to an accusation decree: once the objection is validly withdrawn, the objection proceedings become devoid of purpose and are struck from the docket; the accusation decree attains executory force. Any already fixed public hearing is cancelled, and costs may be waived where the court so orders.
