The Bellinzona criminal court noted that the opposition to a decree of accusation had been withdrawn by defense counsel. It therefore struck the case from the roll, declared the decree of accusation enforceable, and cancelled the public hearing scheduled for 9 March 2004. The court ordered that no fees or costs be levied for the present decision.
Arts. 210 and 211 CPP; withdrawal of opposition against a decree of accusation. Once the opposition is withdrawn, the objection proceedings lapse, the criminal case is struck from the roll, and the decree of accusation becomes enforceable. Any public hearing already fixed is cancelled as superfluous. In the absence of a substantive adjudication, no court costs are charged for the procedural striking order unless otherwise provided.

Non si prelevano né tasse né spese dell'attuale decisione.
