Resumo

The opponent withdrew the objection lodged against the criminal decree of accusation. The Pretura penale, sitting with Judge Marco Ambrosini, therefore struck the case from the roll and declared the decree enforceable. The seized case file and the Nepalese knife were returned to the public prosecutor for further handling within his competence. The court imposed no justice fee, but ordered the procedural costs of CHF 30 to be borne by the opponent.

Art. 210-211 CPP; withdrawal of opposition to a decree of accusation: upon valid withdrawal of the objection, the criminal proceeding is struck from the roll and the decree of accusation acquires enforceability. The court may simultaneously regulate the allocation of procedural costs and order any seized items to be returned to the prosecuting authority for further disposition (consid. implicit).
