In a direct civil appeal before the Second Civil Chamber of the Ticino Court of Appeal, the appellant filed a withdrawal after the parties had reached a comprehensive out-of-court settlement. The court therefore struck the case from the docket. It further ordered that the judicial fee and costs, amounting to CHF 17,000 and already advanced by the appellant, remain borne by the appellant, while party costs are set off.

Art. 352 CPC et seq.; withdrawal after settlement in appeal proceedings. Where the appellant withdraws the action and the opposing party does not object, the court strikes the case from the roll as settled. If the parties have agreed on cost allocation in their settlement, the court gives effect to that agreement; otherwise, costs are allocated according to the applicable fee law. Compensation of party costs may be ordered where expressly provided in the settlement or where the court deems it appropriate in light of the termination by withdrawal.

con cui l'attrice ha chiesto la condanna della convenuta al pagamento di Fr. 23'400'000.- oltre interessi al 5% dal 16 dicembre 1991, ed alla quale la parte convenuta, con risposta 15 novembre 1999, si è opposta.

Ed ora sullo stralcio della causa atteso che la parte attrice, con scritto 21 dicembre 2001 controfirmato dal patrocinatore della convenuta, ha comunicato che "la parte attrice ritira la causa indicata a margine ritenuto che, conformemente all'accordo transattivo globale raggiunto dalle parti in sede extragiudiziale, la tassa e le spese di giustizia sono da porre a carico di chi le ha anticipate, mentre le ripetibili sono compensate".

Visti l'art. 352 e seg. CPC e, per le spese, la vigente LTG

pronuncia

  1. La causa inc. no. 10.1999.00011 promossa direttamente in appello da __________ contro __________ SA, con petizione 10 maggio 1999 è stralciata dai ruoli per transazione.

  2. La tassa di giustizia e le spese in complessivi Fr. 17'000.-, già anticipati dall'attrice, restano a suo carico, compensate le ripetibili.
