Resumo Omnilex

The applicant relied on a revision ground under § 246 Ziff. 2 lit. a ZPO and the court addressed the standard for showing that the three-month period had been met. It held that the deadline starts when the revision ground is known on a secure basis, even if not yet fully proved. For Thurgau law, the applicant must prove timely filing, not merely render it plausible. The court derived this from the absence of an express contrary rule and from § 247 sentence 2 ZPO, which requires the revision petition to contain the grounds and supporting evidence.

Sumário Omnilex

§ 246 Ziff. 2 ZPO; § 247 Satz 2 ZPO; revision deadline and standard of proof: the three-month period for seeking revision begins when the revision ground is known on a sufficiently secure basis, even if full proof is still lacking. In the absence of an express contrary rule, timeliness of the revision request must be proved and need not merely be rendered plausible. The requirement follows from the structure of the revision petition, which must itself set out the invoked grounds and the evidence relied upon (consid. 2).

§ 246 Ziff. 2 aZPO (TG)

1. Der Gesuchsteller machte einen Revisionsgrund nach § 246 Ziff. 2 lit. a ZPO geltend.

Whether compliance with the three-month revision deadline under § 246 Ziff. 2 ZPO must be proven or merely made plausible.

Decisão extraída

The deadline must be proven, not merely made plausible.

Fundamentação extraída

The court held that knowledge triggering the deadline exists once there is secure knowledge, not necessarily full proof. Since Thurgau procedural law does not expressly regulate the standard of proof for timeliness, the same principle as under Zurich law applies: timely filing of the revision request must be shown by proof. This follows in particular from § 247 sentence 2 ZPO, which requires the revision petition to state the grounds and the evidence supporting them.
