Resumo Omnilex

The Obergericht held that it is competent to release a judge from official secrecy. A judge is independent and has no superior in the usual administrative sense. Nevertheless, the Obergericht's supervisory authority over the civil and criminal judiciary allows it to grant the release, so that disclosure authorized by the competent authority is not punishable under Art. 320 StGB.

Sumário Omnilex

Art. 320 StGB; § 12 Abs. 2 GerOG; § 18 Abs. 2 aStPO (TG); competence to release a judge from official secrecy. A judge is not subject to an ordinary hierarchical superior because judicial decisions are rendered independently and only under the law. Where disclosure of official secrets requires authorization, the competent releasing authority may be determined from the supervisory powers over the judiciary. In the canton of Thurgau, the Obergericht, as supervisory authority over the civil and criminal courts, is empowered to grant release from official secrecy (consid. supervisory competence).

§ 12 Abs. 2 GerOG, Art. 320 Ziff. 2 StGB, § 18 Abs. 2 aStPO (TG)

ARGVP 1990 S. 93).

Questão jurídica principal

Whether the Obergericht is competent to release a judge from official secrecy.

Decisão extraída

Yes. Because a judge has no hierarchical superior in the ordinary sense, the Obergericht may exercise supervisory authority over the civil and criminal judiciary and grant the release from official secrecy.

Fundamentação extraída

A judge decides independently and is bound only by law, so the notion of a direct superior does not apply. The Obergericht, however, has supervisory powers over the judiciary under the cited constitutional and statutory provisions; on that basis it is the competent releasing authority.
