The court held that HIV transmission by the father to a child he later fathered does not constitute grievous bodily harm or spreading human diseases against that child. The protected object of Arts. 122 ff. StGB is the human being, not the unborn child. Injuries to the fetus are governed exclusively by the abortion provisions, which protect unborn life from conception onward but do not create a bodily-integrity offence before birth. Art. 122 StGB, Art. 231 Ziff. 1 StGB


1. X erwartete vom Berufungskläger ein Kind. Aufgrund einer Kontrolluntersuchung stellte sich heraus, dass dieser sie mit dem HI-Virus angesteckt hatte. Der Berufungskläger wurde durch die Vorinstanz wegen schwerer Körperverletzung sowie Verbreitens menschlicher Krankheiten verurteilt.

2. Es stellt sich die Frage, ob der Berufungskläger die Tatbestände der Körperverletzung und des Verbreitens menschlicher Krankheiten auch gegenüber dem von ihm gezeugten Kind erfüllt. Die Vorinstanz stellte in diesem Zusammenhang zutreffend fest, dass die Abtreibungstatbestände das ungeborene Leben abschliessend schützen. Diesem Ergebnis ist grundsätzlich beizupflichten, da der Zeugungsakt HIV-Positiver nicht als Körperverletzungsdelikt zum Nachteil des dadurch gezeugten Kinds anzusehen ist (Koch, in: Aids und Strafrecht, Berlin 1996, S. 185 f.). Vielmehr kommt bei den Art. 122 ff. StGB nur der Mensch als Tatobjekt in Frage. Vor der Geburt dagegen besteht kein strafrechtlicher Schutz vor Angriffen auf die körperliche Integrität oder die Gesundheit (Trechsel, Schweizerisches Strafgesetzbuch, Kurzkommentar, Zürich 1989, vor Art. 122 N 1). Die Verletzung der Leibesfrucht fällt vielmehr unter die Bestimmungen über die Abtreibung, da die Abgrenzung des Tatobjekts, des Menschen, von der Leibesfrucht bei der Körperverletzung nicht anders erfolgen kann als bei der Tötung (Keller, Die Körperverletzung im schweizerischen Strafrecht, Diss. Zürich 1957, S. 16). Da indessen auch die Abtreibungstatbestände frühestens mit Eintritt der Konzeption greifen (Stratenwerth, Schweizerisches Strafrecht, BT I, 5.A., § 2 N 4; Rehberg/Schmid, Strafrecht III, 6.A., S. 16 f.; Schubarth, Kommentar zum Schweizerischen Strafrecht, BT, 1.Bd., Zürich 1982, Art. 118 N 51 f., vgl. auch Systematische Einleitung N 16; Trechsel, vor Art. 118 StGB N 2), liegt gegenüber dem Kind kein strafbares Verhalten vor.
