The Rekurskommission addressed the formal requirements of a complaint in debt-enforcement and bankruptcy supervisory proceedings under Art. 17 SchKG. It held that, where federal law is silent, cantonal law governs form and content; by federal law, however, the complainant must indicate the changes sought and briefly explain the alleged violation of federal law. In the canton concerned, the ZPO applies by analogy. A complaint lacking a request is inadmissible.

Art. 17 SchKG; form and content of the complaint in debt-enforcement supervisory proceedings: Where federal law contains no specific rules, cantonal law determines the form, content, and handling of the complaint. As a matter of federal law, the complainant must state the amendments sought to the challenged decision and briefly indicate which federal legal norms were violated and in what respect. In the absence of express cantonal provisions, the procedural rules of the cantonal civil procedure code apply by analogy, in particular the rules on appellate procedure; the complaint must be in writing and contain a request and a brief statement of reasons. A complaint lacking any request is inadmissible (consid. 1).

Form und Inhalt der Beschwerde in Schuldbetreibungs- und Konkurssachen

Art. 17 SchKG

Soweit das Bundesrecht nichts vorschreibt, bestimmt das kantonale Recht Form und Inhalt der Beschwerde nach Art. 17 SchKG sowie deren Behandlung durch die Aufsichtsbehörden. Von Bundesrechts wegen muss der Beschwerdeführer angeben, welche Aenderungen des angefochtenen Entscheids er beantragt, und ausserdem kurz darlegen, welche Bundesrechtssätze und inwiefern sie durch den angefochtenen Entscheid verletzt werden (Amonn, Grundriss des Schuldbetreibungs- und Konkursrechts, 5.A., § 6 N 40 ff.; PKG 1984 Nr. 45 S. 132 f.). Da die kantonale Gesetzgebung keine ausdrücklichen Bestimmungen über das Beschwerdeverfahren nach Art. 17 SchKG enthält, gelten nach konstanter Praxis die Vorschriften der ZPO sinngemäss, insbesondere diejenigen über das Rekursverfahren (§§ 234 ff. ZPO). Das Verfahren ist schriftlich, die Beschwerde hat einen Antrag sowie eine kurze Begründung zu enthalten, der Gegenpartei ist (mit Ausnahme des Rekurses gegen eine den Arrest ablehnende Verfügung; vgl. RBOG 1993 Nr. 25) Gelegenheit zur Stellungnahme einzuräumen, und es findet - von wenigen Ausnahmen abgesehen - nur ein einfacher Schriftenwechsel statt; diese Grundsätze gelten für das Verfahren vor der unteren und der oberen Aufsichtsbehörde. Enthält die Beschwerde keinen Antrag, ist auf sie nicht einzutreten (vgl. PKG 1984 Nr. 45 S. 133).
