Questão jurídica principal
What formal requirements govern a complaint under Art. 17 SchKG when federal law is silent?
Decisão extraída
The complaint must state the requested changes to the challenged decision and briefly explain which federal rules were violated and how; if it contains no request, it is inadmissible.
Fundamentação extraída
Where federal law does not prescribe otherwise, cantonal law governs form and content. By federal law, the complainant must specify the relief sought and give a concise statement of the alleged violation. In the absence of an express cantonal regulation, the rules of the ZPO apply by analogy, including written procedure, a request and brief reasoning, and generally a single exchange of briefs.
