The defendant appealed a judgment of the District Court of Schwyz in a criminal case concerning multiple attempted coercion and multiple intentional traffic-rule violations. After the appeal was timely announced, the motivated judgment was sent, and the defendant then informed the Kantonsgericht that she was withdrawing the appeal. betreffend

mehrfache versuchte Nötigung, mehrfache vorsätzliche Verletzung von Verkehrsregeln

(Berufung gegen das Urteil des Bezirksgerichts Schwyz vom 18. Dezember 2019, SGO 2019 5);-

hat der Kantonsgerichtsvizepräsident,

nachdem sich ergeben und in Erwägung:

  • dass die Beschuldigte gegen das Urteil des Bezirksgerichts Schwyz vom 18. Dezember 2019 innert Frist am 27. Dezember 2019 Berufung anmeldete (KG-act. 2; Art. 399 Abs. 1 StPO);

  • dass das begründete Urteil am 7. April 2020 zum Versand kam;

  • dass die Beschuldigte mit Schreiben vom 1. Mai 2020 dem Kantons­gericht den Rückzug der angemeldeten Berufung bekanntgab (KG-act. 3);

  • dass somit infolge Verzichts auf Einreichung der Berufungserklärung im Sinne von Art. 399 Abs. 3 StPO die Berufung praxisgemäss im Verfahren nach § 40 Abs. 2 i.V.m. § 41 Abs. 1 JG präsidial abzuschreiben ist (Art. 386 StPO; STK 2012 22 vom 7. Mai 2012);

  • dass die Gerichtskosten der zweiten Instanz bei diesem Ausgang zu Lasten des Staates gehen;-

verfügt:

1. Die Berufung wird abgeschrieben.

2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

4. Zufertigung an Rechtsanwältin E.________ (2/R), die Staatsanwaltschaft Innerschwyz (1/A) und die Oberstaatsanwaltschaft (1/R) je mit Kopie von KG-act. 3, an Rechtsanwalt B.________ (2/R) und die Vor­instanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten und zum Vollzug) sowie an die Kantons­gerichtskasse (1/ü, im Dispositiv).
