Leistungen der Sozialhilfe sind im Verfahren zur Festsetzung von Unterhaltsbeiträgen des Ehegatten als subsidiär einzustufen. 7. Der Beschwerdeführer glaubt offenbar, eine Person, die von der Fürsorge unterstützt werde, habe keinen Notbedarf. Das ist falsch. Die Unterhaltspflicht ist selbst dann zu regeln, wenn [einer oder] beide Ehegatten Sozialhilfe beziehen (SOG 1994, Nr. 2). Denn die Unterhaltspflicht des Gatten geht der Sozialhilfe vor (Bräm/Hasenböhler: Zürcher Kommentar, Das Familienrecht, N 94 zu Art. 163 ZGB). Sonst wären ja beispielsweise bei der mittellosen Gattin eines Millionärs, die vorübergehend unterstützt wird (nämlich eben bis Alimente verfügt sind), ihre Bedarfspositionen auch ausser Acht zu lassen, mit der Begründung, sie bezahle ja effektiv gar keine Miete und nichts fürs Essen, dieser Aufwand werde von der Fürsorge gedeckt. Sozialhilfe ist vielmehr subsidiär (SOG, a.a.O., Erw. 1.b; Bräm, a.a.O.), häufig auch vorübergehend. Sie wird angepasst, wenn der getrennt lebende Ehepartner Alimente bezahlt. * Obergericht Zivilkammer, Urteil vom 26. November 1998*
