The Civil Chamber of the Obergericht held that the appellant’s recourse against interim measures under Art. 145 ZGB was wholly unfounded. Because the appeal was hopeless, free legal aid could not be maintained for the proceedings. The court therefore held that the appeal costs fall in principle on the appellant, with the Canton of Solothurn advancing them temporarily under the procedural rules. It further denied any compensation to the appellant’s lawyer, while ordering that counsel for the respondent be remunerated directly from public funds.

Ein bestellter Anwalt des aussichtslosen Rechtsmittelführers hat keinen Anspruch auf Entschädigung aus der Staatskasse; demgegenüber ist der Anwalt der Gegenpartei nach den einschlägigen Bestimmungen direkt aus der Staatskasse zu honorieren.
