The Juvenile Court Chamber held that a victim in proceedings against children and juveniles has no party rights and is therefore not entitled to challenge the judgment by legal remedy. The Victim Assistance Act did not alter this position, because Solothurn juvenile procedure excludes civil claims and, consequently, the victim’s participation required by Art. 8(1)(c) OHG is absent. The legal remedy was therefore inadmissible/dismissed for lack of standing.

SOG 1994 Nr. 28 § 162 Abs. 2 StPO, Art. 8 Abs. 1 lit. c Opferhilfegesetz*- Im Verfahren gegen Kinder und Jugendliche ist das Opfer nicht legitimiert, ein Rechtsmittel zu ergreifen.* Im Verfahren gegen Kinder und Jugendliche stehen dem Verletzten keine Parteirechte zu (SOG 1988 Nr. 21). Er ist deshalb auch nicht legitimiert, Rechtsmittel einzulegen (§ 162 Abs. 2 StPO). Das Bundesgesetz über die Hilfe an Opfer von Straftaten (Opferhilfegesetz, OHG), das am 1.1.93 in Kraft trat, hat diese Rechtslage nicht verändert: Zwar gilt Art. 8 Abs. 1 OHG grundsätzlich auch im Verfahren gegen Kinder und Jugendliche, doch können die Kantone in diesem Verfahren laut Botschaft (BBl 1990 II S. 989) gestützt auf Art. 9 Abs. 4 OHG Ausnahmen von den Bestimmungen der Art. 8 Abs. 1 und 9 OHG vorsehen. Eine solche Ausnahme bildet § 150 StPO, wonach privatrechtliche Ansprüche im Jugendstrafverfahren nicht geltend gemacht werden können. Damit wird nicht nur Art. 8 Abs. 1 lit. a, sondern auch lit. c OHG von der Anwendung ausgeschlossen, welche Bestimmung besagt, dass das Opfer den Gerichtsentscheid mit den gleichen Rechtsmitteln anfechten kann wie der Beschuldigte, wenn es sich bereits vorher am Verfahren beteiligt hat. Da das Opfer nach solothurnischem Prozessrecht in keiner Weise am Verfahren gegen Kinder und Jugendliche teilnehmen kann, ist die in Art. 8 Abs. 1 lit. c OHG statuierte Voraussetzung nicht gegeben und das Opfer demzufolge nicht legitimiert, ein Rechtsmittel einzulegen. * Obergericht Jugendgerichtskammer, Urteil vom 7.
