SOG 1992 Nr. 35 ** Art. 22 und Art. 24 RPG; Art. 16 RPV; § 38 PBG.*Bauen in der (übergangsrechtlichen) Landwirtschaftszone. Das Bau-Departement hat in jedem Fall festzustellen, ob ein Bauprojekt zonenkonform ist. Am 1. Juli 1992 sind die Änderungen des Baugesetzes vom 29. Januar 1992 (neu: Planungs- und Baugesetz, PBG) in Kraft getreten. Für den vorliegenden Entscheid ergibt sich in tatsächlicher Hinsicht daraus insofern eine neue Ausgangslage, als das geplante Wohnhaus gemäss § 155 Abs. 4 PBG neu in der Landwirtschaftszone zu stehen käme. Nach den neuen Bestimmungen von § 38 PBG dürfen ausserhalb der Bauzone Bauten und Anlagen nur errichtet werden, wenn ihr Zweck einen Standort ausserhalb der Bauzone erfordert und keine überwiegenden Interessen entgegenstehen. Nachdem mit der gleichen Gesetzesänderung eine Landwirtschaftszone nach Art. 16 RPG ausgeschieden wurde, ist für landwirtschaftliche Bauten, die in der Landwirtschaftszone zonenkonform errichtet werden, in Anwendung von Art. 22 Abs. 2 RPG eine Ausnahmebewilligung nach Art. 24 Abs. 1 RPG nicht Voraussetzung der Errichtung, auch wenn in § 38 Abs. 3 PBG wiederum eine generelle Bewilligungspflicht statuiert ist. Solche zonenkonformen Bauten sind durch die zuständige Baubehörde formell zu bewilligen (Keller, Neubauten in der Landwirtschaftszone, S. 99). Allerdings sind alle Bauvorhaben ausserhalb der Bauzone, welche die zuständigen Gemeindebehörden in der Landwirtschaftszone als zonenkonform nach Art. 22 RPG bewilligen können, der kantonalen Fachstelle zu unterbreiten. Diese hat nach Art. 16 Abs. 1 RPV zu prüfen, ob es sich tatsächlich um ein zonenkonformes Vorhaben handelt, oder Art. 24 RPG zur Anwendung kommt. Diese Triageaufgabe der kantonalen Behörde entspricht nicht nur dem Sinn von Art. 25 Abs. 2 RPG, sie ist zur Verhinderung einer Umgehung vielmehr notwendig und bundesrechtlich geboten. Die Grenzen zwischen Zonenkonformität und Standortgebundenheit sind oft derart schwer erkennbar, dass nur eine kantonale Behörde in der Lage sein wird, eine einheitliche Rechtsanwendung zu gewährleisten. Zudem gehört die Prüfung der Frage, ob Art. 16, 17 oder 18 Abs. 1 RPG in Verbindung mit Art. 22 RPG zur Anwendung kommt, als Prüfung der richtigen Anwendung von Bundesrecht zum Anwendungsbereich von Art. 24 RPG (Vergleiche zum ganzen: Bandli, Bauen ausserhalb der Bauzonen, N 154 mit Hinweisen). In der Praxis ergeben sich dadurch insofern Konsequenzen, als das Bau-Departement im Falle der Zonenkonformität der Baute lediglich eine Feststellungsverfügung trifft, dass die Baute zonenkonform sei, währenddem es in den Fällen, in denen Art. 24 RPG zur Anwendung kommt, einen rechtsgestaltenden Bewilligungsentscheid ausfällt. * Verwaltungsgericht, Urteil vom 10.
