SOG 1977 Nr. 3 ** Art. 145, Art. 159 Abs. 3, Art. 160 Abs. 2 ZGB.*Der Anspruch der Ehefrau auf unentgeltliche Rechtspflege entbindet den Ehemann nicht von der Pflicht, der Frau einen Anwaltskostenvorschuss zu bezahlen. In einer Scheidungssache verfügte der Amtsgerichtspräsident, dass der Ehemann der Ehefrau einen Anwaltskostenvorschuss von Fr. 1200.-- zu leisten habe, zahlbar in monatlichen Raten von Fr. 150.--. Gleichzeitig gewährte der Gerichtspräsident der Ehefrau die unentgeltliche Rechtspflege, schränkte sie aber wie folgt ein: "Sie (die unentgeltliche Rechtspflege) gilt für die Kosten des eigenen Anwalts nur soweit, als diese nicht vom Beklagten bezahlt werden." Der Ehemann erhob gegen die Verfügung Rekurs. Er machte geltend, weil der Ehefrau die unentgeltliche Rechtspflege bewilligt worden sei, sei er für den Anwaltskostenvorschuss nicht vorschusspflichtig. Das Obergericht wies den Rekurs ab. Es stellte fest, dass dem Ehemann auf Grund seiner finanziellen Verhältnisse die Leistung des Vorschusses zumutbar sei, und führte zum Einwand betreffend unentgeltliche Rechtspflege folgendes aus: Wie der Vorderrichter zutreffend ausführt, entbindet den Rekurrenten die seiner Frau gewährte unentgeltliche Rechtspflege nicht von seiner Unterhalts- und Beistandspflicht, wozu auch die Bezahlung eines Anwaltskostenvorschusses gehört. Weder schränkt der prozess- und verfassungsrechtliche Anspruch auf unentgeltliche Rechtspflege die Unterhalts- und Beistandspflicht des Ehemannes ein noch hebt er sie auf. Aus diesem Grund hat der Vorderrichter denn auch die der Ehefrau gewährte unentgeltliche Rechtspflege insofern beschränkt, als sie für die Kosten des Anwalts der Ehefrau nur gelte, sofern diese nicht vom Rekurrenten bezahlt werden. Indes ist in derartigen Fällen die unentgeltliche Rechtspflege auf die Gerichtskosten zu beschränken, das weitergehende Begehren auf unentgeltlichen Rechtsbeistand wird dagegen "zur Zeit abgewiesen". Werden die verfügten Raten des Anwaltsvorschusses von der Gegenpartei nicht bezahlt und sind sie auch auf dem Rechtsweg nicht einzutreiben, kann, auf entsprechendes Begehren, immer noch mit Wirkung ab Zeitpunkt des ersten -- "zur Zeit abgewiesenen" -- Gesuches die volle unentgeltliche Rechtspflege gewährt werden. * Obergericht Zivilkammer, Urteil vom 17.
