Der Regierungsrat hat zur Zeit, als noch er in den Baubewilligungssachen Beschwerdeinstanz war, entschieden - und zwar aus einleuchtenden Gründen - , dass die Vorschrift des § 53 NBR über die Terrainveränderungen nur im Gebiet des Grenzabstandes gelte (GE 1968 Nr. 16).So aufgefasst stellt die Bestimmung eigentlich eine Grenzabstandsvorschrift (für Terrainveränderungen) dar. Wie Doktrin und Praxis seit langem annehmen, finden sich im solothurnischen Recht die privatrechtlichen Abstandsvorschriften auch in der Baugesetzgebung des Kantons und der Gemeinden (Tatarinoff, Das nachbarliche Baurecht des Kantons Solothurn, S. 56 ff; GE 1955 Nr. 14 und 1965 Nr. 15; vgl. auch § 251 EGZB). Nach der Struktur des § 53 Abs. 1 NBR und nach der Interessenlage, die hier in Frage steht, rechtfertigt es sich anzunehmen, hier liege nicht nur eine öffentlichrechtliche (Schutz des Orts- und Landschaftsbildes), sondern auch eine privatrechtliche Norm vor und das Ganze stelle eine gemischtrechtliche Bestimmung dar. * Verwaltungsgericht, Urteil vom 28.
