The criminal chamber of the Obergericht dismissed the appellant’s objections to the interrogation protocol and to a question put to witness XY. § 92 Abs. 1 and 2 StPO; dictation of interrogation protocol by the investigating judge and suggestive questions: dictation of the protocol is admissible where the judge, owing to his file and legal knowledge, concentrates on the essentials and the record is read back or otherwise approved by the examinee, whose signature supports its reliability. Suggestive questions are not per se forbidden unless the applicable procedural law expressly prohibits them; absent such prohibition, their evidentiary value is assessed freely in light of the circumstances, the wording, the person examined, and the subject matter (consid. a-b).

Der Beschwerdeführer beanstandet die Art und Weise der Protokollführung und die Befragung der Auskunftsperson XY vermittelst einer Suggestivfrage. a) Die beanstandete Protokollführung, die derart erfolgt sein soll, dass der Untersuchungsrichter die einzuvernehmenden Personen zuerst befragte und das Ergebnis der Befragung alsdann dem Gerichtsschreiber diktierte, mag zwar bewirken, dass der Verlauf des Verhörs zu wenig plastisch dargestellt ist. Anderseits garantiert das Diktat des Untersuchungsrichters, der gestützt auf seine Akten- und Rechtskenntnisse genau weiss, um was es geht, und der sich deshalb auf das Wesentliche konzentrieren kann, durchaus für die inhaltliche Richtigkeit und Wesentlichkeit dessen, was die Befragung ergab. Da ja der Protokollinhalt dem Einvernommenen alsdann vorgelesen oder zum Durchlesen gegeben und von diesem unterschriftlich als richtig anerkannt wird, ist besonders auch aus diesem Grund nicht ersichtlich, dass die beanstandete Art der Protokollführung nicht hinreichend verlässlich wäre. b) Was die Rüge betreffend Suggestivfrage anbelangt, so ist der Beweis, dass die dem Beschwerdeführer suspekte Antwort das Ergebnis eine Suggestivfrage ist, nicht erbracht. (Dies wird näher ausgeführt.) Abgesehen vom fehlenden Beweis der behaupteten Suggestivfrage wäre aber auch bei Vorliegen einer solchen keine strafprozessuale Rechtsverletzung erfolgt. Die solothurnische StPO zählt nicht zu denjenigen, die Suggestivfragen ausdrücklich als verpöntes Mittel der Befragung hinstellen. Offenbar liegt ihr die erst neuerdings wieder als richtig erkannte Auffassung zugrunde, dass Suggestivfragen bei weitem nicht immer zu falschen Auskünften führen, dass es vielmehr auf den Einzelfall, die Art der Fragestellung, die Person des Befragten und auf den Gegenstand der Befragung ankommt, wobei es der freien richterlichen Beweiswürdigung anheimgestellt ist, den Aussagewert und Wahrheitsgehalt der suggestiv erwirkten Antworten zu eruieren (vgl. dazu Robert Hauser, Der Zeugenbeweis im Strafprozess, 1974, S. 290 und 292). * Obergericht Strafkammer, Urteil vom 30.
