The Obergericht held that court holidays generally also apply to precautionary orders under Art. 145 ZGB. Such orders are not ordinarily covered by the exceptions for accelerated proceedings or matters of growing harm under § 85 ZPO. If an order cannot be deferred for substantive and temporal reasons, the judge must expressly designate it as urgent under § 85 ZPO so the parties are aware that the court-holiday rules do not apply.

Laut § 86 Abs. 2 ZPO ruhen während der Gerichtsferien sämtliche gesetzlichen und richterlichen Fristen, ausgenommen die Fristen und Gerichtsverhandlungen in den Fällen von § 85 ZPO sowie im Einverständnis der Parteien im Schiedsgerichtsverfahren. § 85 ZPO erwähnt die Streitigkeiten des beschleunigten Verfahrens und "Rechtssachen, die im wachsenden Schaden liegen". Grundsätzlich fallen vorsorgliche Verfügungen nach Art. 145 ZGB (§ 230 ZPO) nicht unter diese Bestimmung.
