The Administrative Court refused to hear a complaint against an order concerning road traffic matters because the challenged act was not a departmental order within the meaning of § 51 lit. a GO. The order had been signed by the secretary of the Road Traffic Legal Service, whereas only orders issued and signed by the department head, or by the deputy, fall under that provision. The court therefore declared the complaint inadmissible and forwarded the file to the Police Department for treatment as a complaint under § 6 VRG.

§ 51 lit. a GO; appealability of departmental orders; only orders issued and signed by the departmental head, or exceptionally by the deputy, constitute departmental orders within the meaning of this provision. Orders emanating from subordinate offices do not qualify and are not directly appealable to the Administrative Court. Where the challenged act is not a departmental order, the court shall not enter into the complaint and may transmit the file to the competent department for treatment as a complaint under § 6 VRG.

SOG 1974 Nr. 31 § 51 lit. a GO*.- Verfügungen der Departemente im Sinne dieser Bestimmung sind nur solche Verfügungen, die vom Departementsvorsteher erlassen und unterzeichnet sind.* Nach § 51 lit. a des Gerichtsorganisationsgesetzes können nur Verfügungen der Departemente ans Verwaltungsgericht gezogen werden und nicht auch Verfügungen von Amtsstellen, die den Departementen untergeordnet sind. Nach der Praxis des Verwaltungsgerichtes sind nur solche Verfügungen Departementsverfügungen, die vom Vorsteher des Departementes (oder von seinem Stellvertreter) erlassen und unterzeichnet sind. Das ist vorliegend nicht der Fall. Die angefochtene Verfügung wurde vom Sekretär des Rechtsdienstes für den Strassenverkehr unterzeichnet. Das Verwaltungsgericht kann deshalb auf die gegen diese Verfügung gerichtete Beschwerde nicht eintreten. Die Akten sind im Sinne von § 6 VRG dem Polizeidepartement zuzustellen, zur Behandlung als Beschwerde gegen den Rechtsdienst für den Strassenverkehr. * Verwaltungsgericht, Urteil vom 3.
