Resumo Omnilex

The Zivilkammer held that in summary proceedings the general stay of time limits does not apply, but the parties must be expressly informed of that exception. Because the first-instance legal notice omitted this warning, the husband’s appeal against the order of 2011-04-13 was treated as timely. The court therefore entered into the appeal. It left open whether Easter Monday was a local public holiday affecting the deadline.

Sumário Omnilex

Art. 145 Abs. 2 lit. b and Abs. 3 ZPO; Art. 142 Abs. 3 ZPO; stay of time limits in summary proceedings and duty to warn parties: In summary proceedings, the statutory stay of time limits does not apply as a rule. However, the parties must be expressly informed in the legal notice that this rule is inapplicable; absent such warning, the time limit is exceptionally deemed subject to the stay. If the last day of the deadline falls on a Sunday, the period ends on the next working day under Art. 142 Abs. 3 ZPO. Where the warning is missing, the court need not decide whether a particular day constitutes a locally recognized public holiday (consid. 1).

* Obergericht Zivilkammer, Urteil vom 15. Juni 2011 (ZKBER.2011.31)*
