An appeal filed only in the client's name is not admissible as to the fee note, because the client is not directly aggrieved by a too-low legal-aid compensation. Will der unentgeltliche Rechtsbeistand einer Partei auch sein Entgelt anfechten, hat er in eigenem Namen Rekurs zu erheben, selbst wenn er im Namen seines Mandanten in der Hauptsache Appellation erklärt. * Sachverhalt:* In einem Scheidungsverfahren vertrat Rechtsanwalt X. als unentgeltlicher Rechtsbeistand den Ehemann. Rechtsanwalt X. erhob im Namen des Ehemannes Appellation gegen das erstinstanzliche Urteil. Soweit sich diese gegen die Höhe der armenrechtlichen Kostennote richtete, tritt die Zivilkammer auf die Appellation nicht ein. * Aus den Erwägungen:* Die Festsetzung der armenrechtlichen Kostennote greift direkt in die Rechtsstellung des unentgeltlichen Rechtsbeistandes ein. Die vom unentgeltlichen Rechtsbeistand vertretene Partei ist nie beschwert, wenn dessen Honorar zu tief angesetzt worden ist, einerseits weil sie durch das Gesetz (§ 110 Abs. 4 Zivilprozessordnung, ZPO, BGS 221.1) vor zusätzlichen Forderungen ihres Anwalts geschützt ist und anderseits, weil sie unter Umständen sogar durch die (zu) tiefe Kostennote begünstigt ist, nämlich wenn der Staat die Kosten des unentgeltlichen Rechtsbeistandes von ihr zurückfordert (§ 114 ZPO). Aus diesen Gründen hat der unentgeltliche Rechtsbeistand, der die Höhe des ihm zugesprochenen Honorars beanstanden will, immer in eigenem Namen Rekurs zu erheben (vgl. auch SOG 1990 Nr. 18). * Obergericht Zivilkammer, Urteil vom 7.
