Resumo Omnilex

The excerpt states that child allowances used for the debt-enforcement subsistence minimum are increased by 20% in family-law calculations. This practice remains applicable after the revision of the circular on the enforcement minimum because the revised basic amounts still do not reflect average actual child costs.

Sumário Omnilex

Child allowances under the debt-enforcement subsistence minimum are too low to be used unchanged in family-law maintenance calculations; they are therefore to be increased by 20% in practice. This also applies under the revised circular on the enforcement minimum, since the revised basic amounts still do not correspond to the effective average costs of children (consid. not specified).

Texto completo

Whether child allowances in debt-enforcement law must be increased by 20% for family-law purposes, including under the revised circular on the enforcement minimum.

Decisão extraída

Child allowances are set so low in debt-enforcement law that, in family law, they are increased by 20%; this practice also continues under the revised circular because the new basic amounts still do not correspond to actual average child costs.

Fundamentação extraída

The court relies on established practice and on the fact that the revised basic amounts remain far below the effective average costs of children, as illustrated by child-support tables designed for average financial circumstances.
