Resumo Omnilex

The court held that a refusal of unentgeltliche Rechtspflege is only procedurally final, so a new application is not categorically barred. However, a renewed request based on the same facts is merely a reconsideration request, and Article 29 BV does not guarantee a fresh examination. By contrast, if the applicant's financial situation has materially changed or if new facts or evidence exist that could not previously be raised, Article 29(1) BV requires the court to examine the renewed request.

Sumário Omnilex

Art. 29 BV; renewed request for unentgeltliche Rechtspflege after prior refusal: the denial of legal aid is a procedural order with only formal res judicata. A subsequent application based on the same factual basis constitutes a reconsideration request and, absent special grounds, there is no constitutional right to a new examination. By contrast, where there are genuine novelties, in particular materially changed financial circumstances, or admissible unechte Noven/new evidence or facts that were previously unavailable or could not reasonably have been invoked, the guarantee of a fair procedure under Art. 29 Abs. 1 BV requires the court to enter into the renewed request (consid. II/2a).

Aus den Erwägungen

II.

2.a) Wie bereits im Entscheid vom 31. Oktober 2013 (Erw.

Whether a renewed request for legal aid based on the same facts must be examined again after an earlier refusal.

Decisão extraída

A renewed request based on the same facts is treated as a reconsideration request; there is no constitutional right to have it examined anew.

Fundamentação extraída

A refusal of legal aid is only a procedural order with formal, not material, res judicata. However, Article 29 BV does not entitle a party to repeated review on the same factual basis, otherwise proceedings could be delayed indefinitely.

Questão jurídica principal

Whether changed financial circumstances or newly discovered facts/evidence require the court to enter into a renewed legal aid request.

Decisão extraída

Yes. If financial circumstances have materially changed or if new facts or evidence justify correcting the earlier refusal, the right to a fair hearing requires the court to consider the renewed request.

Fundamentação extraída

True novelties and admissible new evidence can render the prior refusal incorrect; in such cases Article 29(1) BV gives a right to judicial examination and the court must enter into the request.
