Consequently, substantial alterations or extensions of an existing holiday home cannot as a rule be qualified as site-specific either. The recreational purpose of such a building may be fulfilled without the extension; an asserted interest in enlargement does not constitute a particularly protected need (consid. 1). Restrictive application of the ordinance is justified for conversions and extensions of existing holiday homes, since the implementing ordinance itself classifies holiday homes as non-site-specific buildings.

Die Erweiterung eines Ferienhauses gilt nicht als standortbedingte Baute.

Entscheid des Regierungsrates vom 15. Januar 1974 (Nr. 1310a).

Beim vorliegenden Bauvorhaben handelt es sich um einen Anbau an ein bestehendes Ferienhaus. Mit dem geplanten Anbau würde das bisherige Wohnvolumen um ca. einen Drittel vergrössert.

Den Anbau an ein Ferienhaus als besonders schutzwürdiges Interesse zu bezeichnen, geht entschieden zu weit. Der Rekurrent ist nicht dringend auf den Anbau des Ferienhauses angewiesen, handelt es sich doch nur um einen Anbau eines für Erholungszwecke dienenden Hauses. Das Ferienhaus kann den Erholungszweck auch ohne den geplanten, nicht unerheblich grossen Anbau erfüllen. Zudem stellt das Ferienhaus, an das der Rekurrent anbauen will, nur eine Zweitwohnung dar, auf die der Rekurrent nicht angewiesen ist.

Es rechtfertigt sich, bei Um- und Anbauten von schon bestehenden Ferienhäusern die Bestimmungen des Bundesbeschlusses restriktive anzuwenden, da die Vollziehungsverordnung zum Bundesbeschluss gerade Ferienhäuser ausdrücklich als nicht standortbedingte Bauten bezeichnet (Art. 7 Abs. 2 VV zum BMR). Sind Ferienhäuser nicht standortbedingte Bauten, so können auch wesentliche Um- oder Anbauten von Ferienhäusern grundsätzlich nicht als standortbedingte Bauten bezeichnet werden.
