Art. 2 Heimatschutzverordnung; illuminated advertising signs may be prohibited where they disfigure or impair the appearance of local or landscape images. In applying the ordinance, the competent authorities must exercise extreme restraint; light advertisements are in principle admissible only when attached to the object itself, whereas object-unrelated advertising is to be refused (consid. 1). The decisive criterion is the visual impact on the protected townscape or landscape, not merely the commercial interest of the advertiser.

Anbringen von Leuchtreklamen.

Entscheid des Regierungsrates vom 22. Juni 1971 (Nr. 279).

Wie Art. 2 der Verordnung über Natur- und Heimatschutz und die Erhaltung von Altertümern und Kunstdenkmälern (Heimatschutzverordnung) vom 8. November 1932 zu entnehmen ist, sind Reklametafeln, Aufschriften, Lichtreklamen usw. dann zu untersagen, wenn dadurch Orts- und Landschaftsbilder verunstaltet oder in ihrer Erscheinung beeinträchtigt würden. Die kantonale Natur- und Heimatschutzkommission selber hat sich anlässlich ihrer Sitzung vom 28. Mai 1971 bezüglich Leuchtreklamen dahin ausgesprochen, dass für deren Bewilligung äusserste Zurückhaltung anzuwenden sei. Die Leuchtreklamen sollten nur am Objekt selber angebracht werden. Geschäftsfremde Reklamen seien abzulehnen.

Dem von der kantonalen Natur- und Heimatschutzkommission vertretenen Standpunkt kann von der Beschwerdeinstanz grundsätzlich beigepflichtet werden.
