The Regierungsrat held that a request for guardianship under Art. 372 ZGB must be clear and unmistakable. Even if the applicant used the words guardianship or guardian in his letter, the decisive factor is his actual will. Here, the applicant sought to retain a degree of independence and did not unambiguously request a guardianship measure that entails loss of legal capacity. The necessary unequivocal request was therefore missing.

The guardianship authority must not rely on isolated wording but must ascertain the applicant's true will. The decisive criterion is whether the person actually and unequivocally seeks the radical measure of guardianship, including the consequences of loss of legal capacity; if the intention rather points to preservation of a degree of autonomy, the statutory requirement is not met (consid. 1).

Erfordernis des klaren Willens für eine Bevormundung auf eigenes Begehren.

Entscheid des Regierungsrates vom 16. Mai 1972 (Nr. 77).

Es ist zuzugeben, dass der Betroffene in seinem Schreiben verschiedentlich den Ausdruck "Bevormundung" oder "Vormund" verwendete. Bei der Prüfung des Vorliegens der Voraussetzungen von Art. 372 ZGB hat jedoch die Vormundschaftsbehörde nicht so sehr auf den blossen formellen Wortlaut des jeweiligen Gesuches abzustellen, als vielmehr den wahren Willen des Gesuchstellers zu erforschen (vgl. Kommentar Kaufmann zum ZGB Art. 372, N. 4 ff.). Dieser Wille des Gesuchstellers ist aber vorliegend zweifellos nicht auf eine so radikale Massnahme gerichtet, wie sie die Bevormundung mit dem Verlust der Handlungsfähigkeit darstellt. Vielmehr wollte der Gesuchsteller in unverkennbarer Art und Weise eine gewisse Selbständigkeit gewahrt wissen. Jedenfalls liegt, entgegen der Annahme der Vormundschaftsbehörde, kein eindeutiges Begehren vor, wonach der Rekurrent unmissverständlich eine Bevormundung im Sinne von Art. 372 ZGB verlangt. Dieses bestimmte, klare Begehren bildet indessen ein unerlässliches Erfordernis für die Bevormundung gemäss Art. 372 ZGB (vgl. Kommentar Egger zum ZGB Art. 372, N. 5).
