In this published statement, the Regierungsrat clarified the scope of cantonal constitutional criminal competence. Art. 80 KV.

Die Gemeinden haben keine selbständige Strafbefugnis, sondern lediglich eine Anzeigepflicht.

Art. 77 Abs. 2 KV kann zur Begründung einer strafrichterlichen Kompetenz des Gemeinderates nicht herangezogen werden. Dies folgt aus der Systematik der Verfassung; denn Art. 77 steht unter dem Abschnitt "Kantonale Gewalten" (Art. 57 bis 81), hat also keine Anwendung auf die kommunalen Gewalten, die in Art. 82 ff. (Abschnitt III, Kommunale Gewalten) geregelt sind. Art. 77 Abs. 2 KV will besagen, dass die Verwaltungsbehörden (Regierungsrat, Departemente, Erziehungsrat, Sanitätsrat usw). Disziplinarbefugnis besitzen, was an sich eine Selbstverständlichkeit ist, jedoch auch eine Art Rechtsprechung darstellt, und überdies Verwaltungsrechtspflege ausüben (Erlass von Verwaltungsverfügungen, Rekursentscheide, Beschwerdeentscheide), soweit sie nach der geltenden Gesetzgebung hiezu als zuständig erklärt sind. Aber auch diesen kantonalen Verwaltungsbehörden kommt keine strafrichterliche Befugnis zu. Wer im Kanton die Strafrechtspflege ausübt, ist abschliessend in Art. 80 KV genannt. Es sind dies: Der Verhörrichter, die Strafkommission, das Kantonsgericht, die Obergerichtskommission und das Obergericht. Wenn auch den Gemeinden noch eine Strafrechtsbefugnis zukommen sollte, so müsste dies in der geltenden Verfassung irgendwo gesagt sein. Dies ist jedoch nicht der Fall.

Wir halten fest, dass den Gemeinden gemäss geltendem Recht keine selbständige Strafbefugnis mehr zukommt und die Gemeinden lediglich befugt bzw. verpflichtet sind, Anzeige an das Verhöramt oder die Polizei zu erstatten.
