Art. 48 KV.

Verfassungsmässige Amtsdauer. Gleichzeitige Gesamterneuerung aller Gemeinderäte.

Entscheid des Regierungsrates vom 14. Mai 1974 (Nr. 55).

Die Amtsdauer der Gemeinderäte beträgt laut Art. 48 Abs. 1 KV vier Jahre. Ihre Amtsdauer ist also abgelaufen, darum finden in diesem Jahr (1974) die Gesamterneuerungswahlen statt. Die Pflicht zur Durchführung der Gesamterneuerungswahlen bezieht sich auf alle Arten von Gemeinderäten, wie in der Kantonsverfassung unmissverständlich festgehalten wird, und nicht etwa nur auf jene Gemeinderäte, die im Jahre 1970 gesamthaft erneuert wurden. Für die Kirchgemeinderäte, die erst vor kurzem geschaffen wurden, gilt analog die Bestimmung von Art. 48 Abs. 3 KV, wonach während der Amtsdauer frei gewordene Stellen nur für den Rest der Amtsdauer neu besetzt werden können. Es kommt zudem auf dasselbe hinaus, ob ein Rat während der Amtsdauer neu geschaffen oder ob er um einige Mitglieder erweitert wurde; auch in diesem Fall wäre ja der Zeitpunkt der Gesamterneuerung für alle Mitglieder gleich.
