The Regierungsrat addressed the legal effects of a supervisory complaint under administrative law. It held that such a complaint is recognized as an administrative-law institution, but it is limited to matters of public interest and does not create party rights. For that reason, the complainant cannot দাবি reimbursement of costs or compensation from the state. The complaint also does not entitle the complainant to a formal decision, even though the supervisory authority must examine the substance of the complaint and, as a matter of practice, responds to it.

Supervisory complaint in administrative procedure; legal effects. A supervisory complaint is a recognized instrument of administrative review, but it is confined to matters requiring intervention in the public interest and does not confer party rights (consid. 1). Consequently, it does not found any claim to assumption of costs or compensation by the state. Nor does it create a right to a formal decision, since it is an informal report without statutory form or time limits; the supervisory authority is nevertheless obliged to examine whether the invocation of its supervisory powers is substantively justified and to reply in practice (consid. 2).

Die Aufsichtsbeschwerde wird als Rechtsinstitut der Verwaltungsrechtspflege allgemein anerkannt. Sie kann sich aber nur auf Tatsachen beziehen, die im öffentlichen Interesse ein Einschreiten gegen eine Behörde notwendig machen, und enthält die Einschränkung, dass sie keine Parteirechte begründet; dadurch entfällt zum vorneherein ein Anspruch auf Übernahme der Kosten- und Entschädigungsfolgen durch den Staat. Als weder form- noch zeitgebundene Anzeige gibt sie dem Anzeiger keinen Rechtsanspruch auf einen formellen Entscheid. Gemäss konstanter Praxis wird indessen dem Anzeiger stets eine Antwort erteilt. Die Aufsichtsbehörde ist auch rechtlich verpflichtet zu prüfen, ob die durch die Anzeige erfolgte Anrufung ihrer Dienstaufsicht irgendwie sachlich begründet ist.
